Employers certified under H-2A must keep daily records of the hours each
workers actually works. In addition, the employer must retain a record of
the time offered to the workers that work. In addition, the employer must
retain a record of the time offered to the workers that the workers refused
to work.
In each pay period, each worker must be provided a wage statement that shows
hours worked, hours refused, pay for each type of crop, the basis of pay
(i.e. whether the worker is being paid by the hour, per piece rate,
proportional minimum montly rate of pay, etc.). In addition, wages (along
with an explanation as to why deductions were made).
TERMINATION OF WORKERS:
Employers must maintain records concerning any worker who was terminated and
the reason for such termination. In order to negate a continuing liability
for wages and benefits to the terminated worker under the 3/4th guarantee, the
employer must notify the local state employment service office to report the
job abandonment or termination, the date of the abandonment or termination,
and the reason for each. In addition, the employer must indicate if
replacement(s) will be sought for such worker(s).
